88TRADER CLIENT SERVICE AGREEMENT

Agreement between 88Trader.com (“88Trader”, “We”, “Us”) and the Client who registers at the website (“Client”, “You”).

1. Agreement Overview

This Client Service Agreement (“Agreement”) governs the provision of Expert Advisor (EA) software services by 88Trader to the Client. By subscribing to our services, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions contained herein.

2. Service Description

2.1 Core Services

a) Expert Advisor Software

  • AI-powered trading software for Gold (XAU/USD)
  • Automated trading with machine learning
  • Trained on 10+ years of historical Gold data
  • Real-time sentiment analysis & pattern recognition

b) Virtual Private Server (VPS) Hosting

  • Premium VPS included in all packages
  • 99.9% uptime target
  • Optimized for MT4/MT5
  • 24/7 server monitoring

c) Technical Support

  • EA install & configuration
  • Risk parameter customization
  • Ongoing assistance (by package)
  • Monthly updates & optimization

d) Performance Monitoring

  • Real-time performance dashboard
  • Regular performance reports
  • Trade-by-trade history & analytics

3. Subscription Terms

  • Minimum commitment: 3 months
  • Bonus: +1 month free (total 4 months for 3-month payment)
  • Billing: Monthly recurring after initial period; auto-renewal unless cancelled
  • First payment: 3 months upfront; subsequent monthly from month 5
  • Methods: Card, Bank Transfer, Crypto (BTC/ETH/USDT), PayPal (selected regions)
  • Currency: USD
  • Pricing changes: 30 days notice; upgrades immediate (prorated); downgrades next cycle

4. Broker Requirements

4.1 Approved Brokers Only

EA services are restricted to approved brokers only. Currently approved: Vantage Markets. Using non-approved brokers voids service guarantees.

4.2 Technical Justification

  • Proven liquidity & regulated environments
  • Specific API compatibility
  • Gold trading conditions verified by 88Trader
4.3 Account Requirements

Minimum balances by account type; all accounts must be with approved brokers.

4.4 Account Ownership

Client retains full ownership/control of trading accounts. 88Trader has no access to withdraw/transfer funds; we provide software & technical services only.

5. Prohibited Uses

5.1 Prop Firm Accounts

Not supported. EA is designed for personal trading accounts; prop firm rules conflict with EA operations.

5.2 Trading Strategy Restrictions
  • No arbitrage or latency exploitation
  • No HFT / tick scalping / broker delay exploitation
  • No demo server error exploitation
5.3 Prohibited Actions by Client
  • No sharing/reselling or reverse engineering the EA
  • No non-approved brokers
  • No manual Gold trades that interfere with EA
  • No illegal/fraudulent use

6. Performance & Risk Disclosure

  • No guarantees: Trading carries risk; past results do not guarantee future performance.
  • Historical figures (informational, not guarantees): 10–20% avg. monthly return; 68–78% win rate; 12–30% max historical drawdown.
  • Risk management: 2–10%/trade adjustable; Client sets risk; only trade capital you can afford to lose.
  • Market risks include volatility, gaps, slippage, news events, technical failures, and force majeure.

7. Client Responsibilities

  • Open/fund approved broker accounts and maintain margin
  • Provide accurate info; keep accounts in good standing
  • Comply with broker terms and local laws
  • Protect credentials; report issues promptly
  • Participate in setup consultations; keep contacts updated

8. 88Trader Obligations

  • EA setup within 72h of broker confirmation
  • VPS with 99.9% uptime target
  • Support per package tier; monthly optimization
  • Performance/technical monitoring
8.1 Technical Support Standards

Basic Package: Email support, 24–48 hour response
Pro Package: WhatsApp support, same-day response
Elite Package: VIP support, immediate phone response

8.2 Service Guarantees
  • 30-Day Performance Guarantee
    If EA fails to perform according to documented benchmarks within first 30 days, Client may request full refund of subscription fee.
  • VPS Uptime Guarantee
    If VPS downtime exceeds 0.1% monthly and causes measurable trading loss, 88Trader will compensate affected service fees.
  • 24-Hour Setup Guarantee
    If setup exceeds 24 hours from broker account confirmation, Client receives first month free.
  • Support Response Guarantee
    Pro/Elite clients receive same-day support response or receive 50% discount on next month's subscription.

9. Intellectual Property

  • EA and algorithms remain 88Trader property
  • License is non-exclusive, non-transferable, active only during subscription
  • No copying, reverse engineering, sublicensing, or removing notices
  • Upon cancellation, license terminates; remote disable may apply

10. Fees & Refunds

  • Fees charged in advance; USD; taxes excluded; late payment may suspend service
  • 30-Day Money-Back: First-time only; claim within 30 days; verification required; refund within 14 business days after approval
  • No refunds after 30 days; cancel to prevent future charges; no proration
  • Unauthorized chargebacks → termination; collection may be pursued

11. Cancellation & Termination

  • Client may cancel after 3-month minimum with 7 days’ email notice; effective end of current cycle
  • 88Trader may terminate for breaches, non-payment, non-approved brokers, fraud, illegal use, chargebacks
  • Upon termination: access revoked; no refunds for remaining period; fees due immediately

12. Limitation of Liability

Maximum liability: Total fees paid by Client in the 3 months preceding the claim.

88Trader is not liable for trading losses, indirect/consequential damages, data loss, broker/market issues, third-party actions, or force majeure.

13. Disclaimers & Warranties

  • Services are provided “AS IS” and “AS AVAILABLE” without implied warranties
  • No financial advice; EA outputs are not recommendations
  • No guarantee of uninterrupted or error-free operation
  • Not responsible for broker services or availability

14. Indemnification

Client agrees to indemnify and hold harmless 88Trader and affiliates against claims arising from Client’s use, breaches, unlawful acts, trading outcomes, or third-party claims.

15. Confidentiality & Data Protection

  • Both parties keep confidential: algorithms, trading data, strategies, marked confidential info
  • 88Trader collects performance/technical/contact/billing data for operation & improvement
  • Security: SSL, secure VPS, audits, GDPR-compliant handling, no broker passwords stored
  • Retention: service duration + 12 months; deletion on request; anonymized analytics may remain

16. Affiliate & Profit Sharing Arrangements

  • Standard Affiliate: 5%/10%/15% on first month only; approved brokers required
  • Profit Sharing (Non-approved brokers via IB): 0–20% based on monthly profit; separate Agreement; verification required
  • Referral does not affect service quality; Client responsible for applicable fees

17. Force Majeure

Neither party liable for delays/failures due to events beyond control (acts of God, war, regulation, telecom/Internet failures, cyberattacks, broker failures, power, pandemics). Obligations paused; reasonable efforts to resume.

18. Dispute Resolution

  1. Negotiation: Email support@88traders.vtrcreative.xyz; response within 5 business days; 30-day good-faith negotiation.
  2. Mediation: If unresolved, mediation in Malaysia; costs split; 60 days.
  3. Arbitration: Binding arbitration in Malaysia under Malaysian law; each bears own costs unless decided otherwise.
  4. Class Waiver: No class actions; disputes resolved individually.

19. General Provisions

  • Entire Agreement: Supersedes prior understandings
  • Amendments: 30 days notice; material changes require consent; Client may terminate
  • Severability & Waiver: Unenforceable parts modified; no implied waivers
  • Assignment: Client needs consent; 88Trader may assign to affiliates/successors
  • Notices: support@88traders.vtrcreative.xyz and Client’s signup email
  • Independent Contractors & Language: No partnership/employment; English controls

20. Governing Law & Jurisdiction

Governing Law: Malaysia. Exclusive jurisdiction: courts of Malaysia. Client responsible for compliance with local laws; confirms legal authority to enter this Agreement.

21. Acknowledgments & Representations

  • Client has read and understood all terms; is 18+ and legally competent
  • Understands trading risks and that performance is not guaranteed
  • Will use only approved brokers; no prop firm accounts
  • Accepts limitations of liability, disclaimers, and legal compliance
